Judge: Linda S. Marks, Case: 2011-00479442, Date: 2022-12-19 Tentative Ruling

1. Motion to Be Relieved as Counsel of Record filed by Newport harbor Ventures, LLC on 9/29/22
2. Motion to Be Relieved as Counsel of Record filed by Vertical Media Group Inc. on 9/29/22
3. Motion to Be Relieved as Counsel of Record filed by Dennis A. D'Alessio on 9/29/22

Attorney Bradley P. Knypstra of Knypstra Zermeno LLP moves to be relieved as counsel for Cross-Defendants/Cross Complainant (1) Newport Harbor Ventures, LLC, (2) Vertical Media Group, and (3) Dennis D’Alessio.

As stated in the Court’s December 5, 2022 Minute Order, the proposed orders were not filed and served at the same time as the notices of motion and declarations pursuant to California Rules of Court, rule 3.1362(d). (ROA # 1318.) Given counsel’s health difficulties, the court found good cause to accept the late filed proposed orders and continued the hearing on these motions to ensure all supporting documents were served on the clients at least 16 court days prior before the hearing. (ROA # 1318.)

At least 16 court days have passed since all documents supporting counsel’s Motions to Be Relieved as Counsel were served on the clients and the Motions remain unopposed.

Tentative Ruling: The unopposed Motions to Be Relieved as Counsel are GRANTED.

A corporation must be represented in court by an attorney. As such, Cross-Defendants/Cross Complainant Newport Harbor Ventures, LLC and Vertical Media Group are ordered to obtain new counsel within a reasonable time. (CLD Constr., Inc. v. City of San Ramon (2004) 120 Cal.App.4th 1141, 1150 [“[T]he court retains authority to dismiss an action if an unrepresented corporation does not obtain counsel within reasonable time.”].)

The order will take effect once moving counsel files proof of service of this order on the clients.

Moving attorney to give notice.
