Motion for Termination of Sanctions filed by Sherwood D. Guy on 12/21/22

Plaintiff SHERWOOD D. GUY seeks an order 1) issuing terminating sanctions, and/or evidentiary sanctions for Defendant’s willful failure to obey the Court’s November 28, 2022, discovery order (“Discovery Order”); or in the alternative 2) compelling immediate compliance with the Discovery Order within 10 calendar days and ordering prospective sanctions of $500 per day that Defendant does not fully comply with the order.

This motion was filed on 12/21/2022, and originally set for hearing on 5/8/2023. Prior to that date, Plaintiff filed a Stipulation and Order to continue the motion. The Court continued the motion to 7/17/2023, but it is unclear whether Defendant has notice of the continued hearing date.

The Court notes there is no opposition, which appears unusual given the harsh nature of the relief requested.

Tentative Ruling: The motion is continued to August 7, 2023 in order for Plaintiff to provide notice of the hearing.
