Judge: Linda S. Marks, Case: 2022-01255848, Date: 2022-11-07 Tentative Ruling
Motion to Be Relieved as Counsel of Record filed by counsel for Eloi S. Coloch Gonzalez on 8/17/22
Motions to be relieved as counsel pursuant to Code of Civil Procedure section 284(2) are governed by California Rules of Court, Rule 3.1362.
All the requirements of California Rules of Court, Rule 3.1362 have been met, and the Declaration of Yen-Yu Liu, Esq. appears to demonstrate good cause for granting the motion based on the “breakdown of the attorney-client relationship, which has significantly impeded counsel’s ability to effectively prosecute this case and represent Plaintiff’s interest.” (Yen-Yu Liu, ¶ 2; ROA 14.) Further, no prejudice appears.
Tentative Ruling: The Motion to be Relieved as Counsel of Record for Plaintiff, Eloi Saul Coloch Gonzalez filed by Yen-Yu Liu, Esq./BD&J, P.C. is GRANTED on the condition that Attorney Liu submit an updated Proposed Order, on Judicial Council Form MC-053 reflecting the current date of the next scheduled hearing. The order relieving counsel Yen-Yu Liu, Esq./BD&J, P.C, as Counsel of Record for Plaintiff Eloi Saul Coloch Gonzalez is effective upon counsel filing proof of service of a copy of the signed order, and this Minute Order, on the client and on all parties that have appeared in the case. (California Rules of Court, Rule 3.1362(e).)
Counsel Yen-Yu Liu to give notice.
