Application/Request for Writ of Possession filed by Alliant Credit Union on 8/17/22
The Court finds that Defendant was properly served as required by Code of Civil Procedure section 512.030. The Court further finds that Plaintiff has established the probable validity of its claim to possession of the 2018 Showhauler motor vehicle, pursuant to the declaration of Stanley Chism.
Tentative Ruling: Plaintiff Alliant Credit Union’s (“Plaintiff”) unopposed Application for Writ of Possession against Defendant Jacqueline A. Mahan aka Jacqueline Mahan (“Defendant”) is GRANTED.
The Court ORDERS Defendant to turn over to Plaintiff the 2018 Showhauler motor vehicle. There is probable cause to believe the 2018 Showhauler motor vehicle is located at 27835 Elk Mountain Drive, Yorba Linda, California 92887, which is the current residence of Defendant. (Declaration of Stanley Chism, ¶ 10.) The failure to turn over the 2018 Showhauler motor vehicle to Plaintiff may subject Defendant to being held in contempt of court. The Court orders Plaintiff to file an undertaking in the amount of $79,710.54, which is twice the value of Defendant’s interest in the 2018 Showhauler motor vehicle.
