Motion to Compel Deposition (Oral or Written)

Plaintiff Bend-Tek, Inc.’s motion to compel Nonparty Cao Bui to comply with Plaintiff’s deposition subpoena is taken off calendar. 

On April 25, 2022, the Court granted Plaintiff’s motion to appoint a discovery referee.  (ROA 487.)  On June 14, 2022, the Court entered an order appointing Judge Flaherty as discovery referee.  (ROA 582.)  And on July 1, 2022, the Court entered an order amending the order appointing a discovery referee, this time ordering that the discovery referee was appointing to hear “all pending discovery motions and all future discovery motions that may be filed by or against any Defendants, Plaintiff, and/or third parties.”  (ROA 613.) 

At issue here is a discovery motion filed by Plaintiff against a third party.  Pursuant to the Court’s July 1, 2022 order, this matter shall be heard by the discovery referee.
