Motion to Be Relieved as Counsel by Counsel for Aaron Schock

BACKGROUND 

On April 27, 2017, Plaintiff Carrier Johnson provided Defendants Aaron Schock and Hyatt House Coachella a proposal for architectural services and related materials and services for a hotel project commonly known as Hyatt House Coachella. Defendant Schock executed the proposal, and Plaintiff provided such services from May 2017 to December 2017. Additional work was also requested beyond the terms of the agreement. Plaintiff performed but Defendants failed to pay Plaintiff for the services and materials, with Plaintiff sustaining damages in the amount of $78,554.89.

 

Defendant Aaron Schock filed a cross-complaint against Stuart Rubin and Glenroy Coachella, LC for indemnity and contribution, alleging that Cross-Defendants agreed to pay Schock for his services, but they failed to pay.

TENTATIVE RULING 

Bruce D. Rudman of Abdulaziz, Grossbart & Rudman’s Motion to Withdraw as Counsel for Defendant/Cross-Complainant Aaron Schock is GRANTED. 

Counsel has asserted valid reasons for withdrawal, i.e., the client has breached a material term of an agreement with counsel relating to the representation, and there has been a breakdown in the attorney-client relationship. (Rules Prof. Conduct, rule 1.16(b)(4), (b)(5).) Counsel has provided the required forms under rule 3.1362 of the California Rules of Court and served the client and opposing parties with the same. There being good cause to grant counsel’s request to withdraw, Bruce D. Rudman of Abdulaziz, Grossbart & Rudman’s Motion to Withdraw as Counsel for Defendant/Cross-Complainant Aaron Schock is GRANTED. This ruling granting counsel’s motion to withdraw shall become effective upon filing of proof service of this ruling upon Defendant/Cross-Complainant Aaron Schock.
