Having considered the petitioning papers, the Court rules as follows.
BACKGROUND
On January 27, 2020, Plaintiff N.A., a minor, by and through his guardian ad litem Noushin Anvarzadeh (“Plaintiff”), filed this action against Defendants Los Angeles Unified School District (“District”) and Amara Kamara (“Kamara”) for violations of the Unruh Civil Rights Act, violations of Government Code section 11135, negligent hiring, retention, and supervision, intentional infliction of emotional distress, negligent infliction of emotional distress, assault, and battery.
On August 10, 2020, the Court appointed Noushin Anvarzadeh to serve as Plaintiff’s guardian ad litem.
On October 22, 2020, Plaintiff filed a first amended complaint against the same defendants for negligence, negligent hiring, training, supervision, and retention, battery, assault, violations of the Ralph Act, violations of the Unruh Act, violations of the Bane Act, and intentional infliction of emotional distress.
On November 23, 2020, the District filed an answer. On January 22, 2021, Kamara filed an answer.
On May 26, 2023, Plaintiff filed a notice of settlement.
On April 30, 2024, Petitioner Noushin Anvarzadeh (“Petitioner”) filed a petition to approve minor’s compromise to be heard on May 29, 2024.
PETITIONER’S REQUEST
Petitioner Noushin Anvarzadeh asks the Court to approve the compromise of the pending action of Plaintiff N.A.
DISCUSSION
Petitioner asks the Court to approve placement of the settlement proceeds in a special needs trust. The Court’s Probate Legal Unit must review the special needs trust paperwork before the Court can approve it.
The Court continues the hearing to allow the Probate Legal Unit to review the special needs trust paperwork.
CONCLUSION
The Court CONTINUES the hearing on the petition to approve the compromise of Plaintiff N.A.’s action filed by Petitioner Noushin Anvarzadeh to June 24, 2024, at 1:30 p.m. in Department 28 of the Spring Street Courthouse.
Petitioner is ordered to give notice of this ruling.
Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
