Judge: Lisa R. Jaskol, Case: 20STCV33098, Date: 2025-04-29 Tentative Ruling

Case Number: 20STCV33098    Hearing Date: April 29, 2025    Dept: 28

Having considered the petitioning papers, the Court rules as follows.

BACKGROUND

On August 28, 2020, Plaintiffs Maranda Brooks, Tia Brooks, Nicholas Ruppert, Kayden Brooks ("Kayden Brooks"), and Kyrie Brooks ("Kyrie Brooks") filed this action against Defendants Worthy Goodman (“Defendant”) and Does 1-50 for negligence.

On May 18, 2022, Defendant filed an answer.

On October 18, 2024, Plaintiffs filed a notice of settlement.

On October 31, 2024, the Court dismissed the action without prejudice at Plaintiffs’ request.

On December 6, 2024, the Court vacated the dismissal of the claims of Kayden Brooks and Kyrie Brooks based on the parties’ stipulation.

On March 14, 2025, the Court appointed Maranda Brooks to serve as guardian ad litem for Kayden Brooks and Kyrie Brooks.

On March 18, 2025, Petitioner Maranda Brooks filed petitions to approve the compromise of the claims of Kayden Brooks and Kyrie Brooks.  The petitions were set for hearing on April 29, 2025.

PETITIONER’S REQUESTS

Petitioner Maranda Brooks asks the Court to approve the compromise of the claims of minor Plaintiffs Kayden Brooks and Kyrie Brooks.

DISCUSSION

A.   Kayden Brooks

Petitioner has submitted a completed petition with all required information and attachments. The Court has reviewed the proposed settlement and finds that it is fair and reasonable.  The Court grants the petition to approve the compromise of Kayden Brooks' claims.

The net settlement amount of $3,193.00 is to be deposited in insured accounts in Bank of America, Beverly-Wilshire Financial Center, 9454 Wilshire Blvd., Beverly Hills, CA 90212, (310) 734-0321, subject to withdrawal only on authorization of the Court.

B.   Kyrie Brooks

The petition to approve the compromise of Kyrie Brooks' claims mistakenly attaches copies of the documents supporting the petition to approve the compromise of Kayden Brooks’ claims.  Petitioner has not provided evidence supporting the petition to approve the compromise of Kyrie Brooks’ claims.  The Court therefore denies the petition to approve the compromise of Kyrie Brooks’ claims without prejudice.

CONCLUSION

The Court GRANTS Petitioner Maranda Brooks’ petition to approve the compromise of minor Plaintiff Kayden Brooks’ claims filed on March 18, 2025. The Court sets an OSC Re: Distribution of Net Settlement on June 23, 2025, at 8:30 a.m., in Department 28 of the Spring Street Courthouse.

The Court DENIES without prejudice Petitioner Maranda Brooks’ petition to approve the compromise of minor Plaintiff Kyrie Brooks’ claims filed on March 18, 2025.

Petitioner is ordered to give notice of this ruling.
