            Note that once the Court has issued a tentative, the Court has the inherent authority not to allow the withdrawal of a motion and to adopt the tentative ruling as the order of the court.   
 
            If you submitted a courtesy copy of your papers containing media (such as a DVD or thumb drive), unless you request the return of the media in your papers, the court will destroy it following the hearing of your matter.

Having reviewed Defendant Food 4 Less’s unopposed motions to compel responses to form interrogatories, special interrogatories, and request for production of documents, the Court rules as follows. 

On May 17, 2023, Defendant Food 4 Less served Form Interrogatories, Set No. One, Special Interrogatories, Set No. One, and Request for Production of Documents, Set No. One, on Plaintiff Jose Sanabria. 

Responses were due on June 20, 2023. Plaintiff Jose Sanabria failed to provide timely responses. Defendant Food 4 Less now moves to compel code-compliant responses. 

The Court grants the motions to compel responses to the form and special interrogatories under Code of Civil Procedure section 2030.290, subdivision (b), and orders Plaintiff Jose Sanabria to provide verified responses to the interrogatories compliant with Code of Civil Procedure sections 2030.210, subdivision (a), and 2030.220 without objections by October 1, 2023. 

The Court grants the motion to compel responses to the request for production and production of items under Code of Civil Procedure section 2031.300 and orders Plaintiff Jose Sanabria to provide verified responses under Code of Civil Procedure section 2031.210 and to produce the documents, electronically stored information, and/or other things requested without objections by October 1, 2023. 

Defendant Food 4 Less requests monetary sanctions of $1,085.00 for each motion, based on 5 hours of attorney’s work at a rate of $205.00 per hour and 1 $60.00 filling fee.  Counsel spent 2.5 hours preparing each motion and anticipates spending 2.5 hours to prepare a reply and attend the hearing. The motions are substantially similar, are unopposed and will be heard together. 

The Court awards sanctions of $1,000 for all motions, based on 4 hours of attorney’s work and 3 filing fees, under Code of Civil Procedure sections 2023.030, subdivision (a), 2030.290, subdivision (c), and 2031.300, subdivision (c). 

The Court orders Plaintiff Jose Sanabria and his counsel to pay Defendant Food 4 Less $1,000 in sanctions by October 1, 2023. 

Moving party is ordered to give notice of this ruling.
