Having considered the petitioning papers, the Court rules as follows. 

BACKGROUND 

On January 15, 2021, Plaintiffs Heather Beach and Kalila Beach filed this action against Defendants Lyft, Inc., Jirair J. Kasabyan, Manuk Kasabyan, Roxana A. Salem, Mohammad Dolatabadi, and Doe defendants for personal injury and property damage. 

On March 23, 2021, Defendant Jirair J. Kasabyan filed an answer. 

On March 26, 2021, Defendants Roxana A. Salem and Mohammad Dolatabadi filed an answer and a cross-complaint against Cross-Defendants Lyft, Inc., Jirair J. Kasabyan, Manuk Kasabyan and Roes 1-20 for indemnity and contribution. 

On June 4, 2021, Defendant Lyft, Inc. filed an answer to Plaintiffs’ complaint. 

On August 15, 2023, Petitioner Heather Beach (“Petitioner”) filed a petition to approve the compromise of minor Kalila Beach’s claims to be heard on August 30, 2023. The Court continued the hearing on the petition to September 19, 2023. 

PARTY’S REQUEST 

Petitioner asks the Court to approve the compromise of the pending action of Plaintiff Kalila Beach. 

DISCUSSION 

Petitioner’s application is complete with all applicable attachments. However, the Petitioner requests that the net balance be deposited in a financial institution in New York. Petitioner should inform the Court if special circumstances would create a hardship for Petitioner if the funds were deposited in a financial institution in California.  (See Form MC-350, Section 18b(2) [funds to “be deposited in insured accounts in one or more financial institutions in this state”].) 

The Court denies the petition. Petitioner may appear at the hearing on the petition if Petitioner believes the requirement to deposit the funds in a California financial institution creates an undue hardship. 

CONCLUSION 

The Court DENIES the petition to approve the compromise of the pending action of minor Kalila Beach filed by Petitioner Heather Beach. 

Petitioner is ordered to give notice of this ruling. 

Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
