Having considered the petitioning papers, the Court rules as follows. 

BACKGROUND 

On April 6, 2021, Plaintiffs Jazeer Keyes (“Keyes”), Tanya Davis (“Davis”), Jae’yon Wagner (“Jae’yon Wagner”), and Tamila Wagner (“Tamila Wagner”) filed this action against Defendants Lenita Sinna Dee Lewis (“Defendant”) and Does 1-100 for motor vehicle tort and general negligence. 

On April 27, 2021, the Court appointed Tamila Wagner to serve as Jae’yon Wagner’s guardian ad litem. 

On January 3, 2025, Davis filed a petition for approval of the compromise of Keyes’s action. 

PETITIONER’S REQUEST 

Petitioner Tanya Davis asks the Court to approve the compromise of the pending action of minor Plaintiff Jazeer Keyes. 

DISCUSSION 

          The petition omits page 6 of the Judicial Council MC-350 form. 

          Section 12a(1) of the petition states that total medical expenses were $13,308.80.  Section 12a(2) of the petition states that $13,208.80 of these expenses were paid.  However, the attached letter from the Department of Health Care Services states that Medi-Cal paid $22,853.06 in medical expenses. 

          Section 18b(2) of the petition states that Keyes will receive $6,500.00.  However, Section 20 of the petition states that Keyes will receive $6,050.00. 

The Court denies the petition. 

CONCLUSION 

The Court DENIES without prejudice the petition to approve the compromise of minor Plaintiff Jazeer Keyes’s claims filed by Petitioner Tanya Davis on January 3, 2025. 

Petitioner is ordered to give notice of this ruling. 

Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
