Having considered the petitioning papers, the Court rules as follows. 

BACKGROUND 

On August 6, 2021, Plaintiffs Margarito Lopez Ortega, Carlos Garcia, a minor, by and through his guardian ad litem Gerardo Saldana, Guadalupe Garcia Salgado, a minor, by and through her guardian ad litem Gerardo Saldana, and Graciela Salgado-Gutierrez filed this action against Defendants Supershuttle Los Angeles, Inc., California Blue Transportation, LLC, Doyle Barton, and Does 1-30 for negligence. 

On August 16, 2021, the Court appointed Gerardo Saldana to serve as Plaintiff Guadalupe Garcia Salgado’s guardian ad litem.  On August 26, 2021, the Court appointed Gerardo Saldana to serve as Plaintiff Carlos Garcia’s guardian ad litem. 

On April 25, 2022, Defendants Supershuttle Los Angeles, Inc., California Transportation, LLC, and Doyle Barton filed an answer. 

On April 25, 2024, the Court dismissed with prejudice the claims of Plaintiffs Margarito Lopez Ortega and Carlos Garcia against Defendants Supershuttle Los Angeles, Inc., Doyle Barton, and California Blue Transportation, LLC, with a mutual waiver of costs. 

On December 31, 2024, Plaintiffs filed a notice of settlement. 

On January 2, 2025, the Court dismissed with prejudice Plaintiff Graciela Salgado-Gutierrez’s claims against all defendants. 

On April 18, 2025, Petitioner Gerardo Saldana (“Petitioner”) filed a petition for approval of the compromise of minor Plaintiff Guadalupe Garcia Salgado’s claims. 

PETITIONER’S REQUEST 

Petitioner asks the Court to approve the compromise of the pending action of minor Plaintiff Guadalupe Garcia Salgado. 

DISCUSSION 

Section 12a(4) of the petition states that none of the medical expenses will be paid or reimbursed from the settlement proceeds.  However, Section 16b of the petition states that $9,378.77 of the medical expenses will be paid from the settlement proceeds.  Petitioner should address this discrepancy. 

The Court denies the petition without prejudice. 

CONCLUSION 

The Court DENIES without prejudice Petitioner Gerardo Saldana’s petition to approve the compromise of minor Plaintiff Guadalupe Garcia Salgado’s claims filed on April 18, 2025. 

Petitioner is ordered to give notice of this ruling.
