On April 24, 2024, the Court granted petitions to approve the compromise of two of the three minor Plaintiffs’ claims. Plaintiffs now ask the Court to dismiss the case without requiring them to submit a petition to approve minor’s compromise for the third minor Plaintiff, Dominic Martinez. Plaintiffs state that Defendants’ insurer State Farm issued a settlement check for Dominic Martinez which was made out to his father, Luis Enrique Martinez, on his behalf and was split into one check for $1,672.53 for Dominic Martinez and another check for $127.47 to the Department of Health Care Services. State Farm did not require a petition for minor’s compromise for Dominic Martinez.
Although State Farm did not require a petition for minor’s compromise, the Court will not dismiss the case until it approves a petition to approve the compromise of minor Plaintiff Dominic Martinez’s claim.
The Court continues the order to show cause re: dismissal for 60 days or to the next available date.
