Having considered the petitioning papers, the Court rules as follows.
BACKGROUND
On February 1, 2022, Plaintiffs Sandra Zuleyma Gramajo Cifuentes (“Cifuentes”), Kevin Rolando Barrios Santizo, Kevin Adan Barrios Gramajo, a minor, and Angel David Barrios Gramajo, a minor, filed this action against Defendants Marta Matilde Nunez Saul (“Defendant”) and Does 1-100 for motor vehicle tort and general negligence.
On February 7, 2022, the Court appointed Cifuentes to serve as Plaintiff Kevin Adan Barrios Gramajo’s guardian ad litem. On February 10, 2022, the Court appointed Cifuentes to serve as Plaintiff Angel David Barrios Gramajo’s guardian ad litem.
On June 15, 2022, Defendant filed an answer. On June 21, 2022, Defendant filed a cross-complaint against Cross-Defendants Cifuentes and Roes 1-10 for indemnity, comparative contribution, and property damage. On July 13, 2023, Cifuentes filed an answer to the cross-complaint. On April 26, 2024, the Court dismissed Cifuentes from the cross-complaint with prejudice at Defendant’s request.
On March 11, 2024, Plaintiffs filed a notice of settlement.
On July 10, 2024, the Court granted Petitioner Sandra Zuleyma Gramajo Cifuentes’s petition for expedited approval of the compromise of Plaintiff Angel David Barrios's claims.
On December 10, 2024, Petitioner Sandra Zuleyma Gramajo Cifuentes (“Petitioner”) filed a second amended petition for expedited approval of the compromise of the claims of Plaintiff Kevin Adan Barrios Gramajo (“Plaintiff”).
PETITIONER’S REQUEST
Petitioner
asks the Court to grant the petition to approve the compromise of Plaintiff’s
claims.
Petitioner has submitted a complete petition with all required information. The Court grants the petition and orders that the net settlement amount of $1,600.00 be deposited in insured accounts in Wells Fargo Bank, 245 N. Larchmont Blvd., Los Angeles, CA 90004, (310) 550-2101, subject to withdrawal only on authorization of the Court.
CONCLUSION
The Court GRANTS the second amended petition for expedited approval of the compromise of minor Plaintiff Kevin Adan Barrios Gramajo’s claims filed by Petitioner Sandra Zuleyma Gramajo Cifuentes on December 10, 2024. The Court orders that the net settlement amount of $1,600.00 is to be deposited in insured accounts in Wells Fargo Bank, 245 N. Larchmont Blvd., Los Angeles, CA 90004, (310) 550-2101, subject to withdrawal only on authorization of the Court.
The Court sets an OSC Re: Distribution of Net Settlement on April 9, 2025, at 8:30 a.m., in Department 28 of the Spring Street Courthouse.
