Having considered the petitioning papers, the Court rules as follows.
BACKGROUND
On April 1, 2022, Plaintiff Liam Vicente, by and through his guardian ad litem Sandra Gomez (“Plaintiff”), filed this action against Defendants Dmitry Romanenko, M.D. (“Romanenko”), Mother Teresa Medical Center of Huntington Park, Gage Medical Center, Inc., Hollywood Presbyterian Medical Center (“Hollywood Presbyterian”), and Does 1-100 for general negligence and emotional distress.
On June 23, 2022, Hollywood Presbyterian filed an answer. On July 14, 2022, Romanenko filed an answer. On October 28, 2022, Gage Medical Clinic, Inc., dba Mother Theresa Medical Center of Huntington Park (erroneously sued as Gage Medical Center, Inc. and Mother Teresa Medical Center of Huntington Park) filed an answer.
On July 12, 2023, the Court dismissed Hollywood Presbyterian with prejudice at Plaintiff’s request.
On August 3, 2023, Petitioner Sandra Gomez (“Petitioner”) filed a petition for approval of minor’s compromise to be heard on September 21, 2023.
PARTY’S REQUEST
Petitioner Sandra Gomez asks the Court to approve the compromise of the pending action of Plaintiff Liam Vicente.
DISCUSSION
Petitioner has submitted a completed application with all applicable attachments. The Court grants the application.
Petitioner requests that the entire net balance be placed into a single-premium deferred annuity. The Court orders the net balance so distributed.
CONCLUSION
The Court GRANTS the petition to approve the compromise of the pending action of minor Liam Vicente filed by Petitioner Sandra Gomez. The Court orders that the net balance be distributed into the single-premium deferred annuity referenced in attachment 18b(3) of the petition.
The Court sets a OSC Re: Distribution of Net Settlement into Single-Premium Deferred Annuity on November 30, 2023, at 8:30 a.m., in Department 28 of the Spring Street Courthouse.
The Court sets a OSC Re: Dismissal of Case (Settlement) on November 30, 2023, at 8:30 a.m., in Department 28 of the Spring Street Courthouse.
Petitioner is ordered to give notice of this ruling.
