Having considered the petitioning papers, the Court rules as follows.
BACKGROUND
On May 5, 2022, Plaintiffs Artak Grigoryan, Tagui Kaladzyan, Louisa Grigoryan, a minor by and through her guardian ad litem Tagui Kaladzyan, and Lilly Grigoryan, minor by and through her guardian ad litem Tagui Kaladzyan, filed this action against Defendants Ferrero U.S.A., Inc., Berberian Enterprises, Inc., dba Jons Fresh Marketplace, and Does 1-50 for negligence, strict liability, res ipsa loquitur, loss of consortium, and negligent infliction of emotional distress.
On July 15, 2022, the Court appointed Tagui Kaladzyan to serve as Plaintiff Lilly Grigoryan’s guardian ad litem. On July 18, 2022, the Court appointed Tagui Kaladzyan to serve as Plaintiff Louisa Grigorian’s guardian ad litem.
On April 10, 2023, Defendant Ferrero U.S.A., Inc. filed an answer. On May 4, 2023, Defendant Berberian Enterprises, Inc. dba Jons Marketplace (erroneously sued and served as Berberian Enterprises, Inc., a California Corporation and dba Jons Fresh Marketplace) filed an answer.
On September 28, 2023, the Court dismissed Defendant Ferrero U.S.A. Inc. with prejudice at Plaintiffs’ request.
On October 28, 2024, Plaintiffs filed a notice of settlement.
On November 18, 2024, Petitioner Tagui Kaladzyan (“Petitioner”) filed petitions to approve the compromise of the claims of minor Plaintiffs Louisa Grigoryan and Lilly Grigoryan. The petitions were set for hearing on January 7, 2025. The Court continued the hearings to February 26, 2025.
PETITIONER’S REQUESTS
Petitioner asks the Court to grant the petitions to approve the compromises of the claims of minor Plaintiffs Louisa Grigoryan and Lilly Grigoryan.
A. Louisa Grigoryan
Petitioner has submitted a complete petition with all required information. The Court grants the petition. The Court orders that the net settlement proceeds of $15,000.00 be deposited in insured accounts at Bank of America, 16640 Ventura Blvd., Encino, CA 91436, subject to withdrawal only on authorization of the court.
B. Lilly Grigoryan
Petitioner has submitted a complete petition with all required information. The Court grants the petition. The Court orders that the net settlement proceeds of $15,000.00 be deposited in insured accounts at Bank of America, 16640 Ventura Blvd., Encino, CA 91436, subject to withdrawal only on authorization of the court.
CONCLUSION
The Court GRANTS Petitioner Tagui Kaladzyan’s petition to approve the compromise of Plaintiff Louisa Grigoryan’s claims. The Court orders that the net settlement proceeds of $15,000.00 be deposited in insured accounts at Bank of America, 16640 Ventura Blvd., Encino, CA 91436, subject to withdrawal only on authorization of the court.
