On February 10, 2025, Plaintiff Brian William Willard (“Plaintiff”) filed an opposition to the motion for summary judgment filed by Defendant Slingshot, LLC dba Hi-Tops Bar (erroneously sued and served as Hi-Tops Bar) (“Defendant”).  On the first page, Plaintiff's opposition states that it was “Filed concurrently with Plaintiff’s Response to Defendant’s Separate Statement of Material Undisputed Facts; Declaration of Sofia Minassian; and Plaintiff’s Compendium of Evidence.”

Defendant’s reply refers to Plaintiff’s response to Defendant’s separate statement, showing that Plaintiff served the response on Defendant.

However, Plaintiff’s response to Defendant’s separate statement, the declaration of Sofia Minassian, and Plaintiff’s compendium of evidence do not appear on the Court’s online docket.  The Court does not know the reason for the documents’ absence.

The Court continues the hearing on Defendant’s motion for summary judgment to a date to be provided at the May 8, 2025 hearing.  At least five court days before the continued hearing date, Plaintiff is to file Plaintiff’s response to Defendant’s separate statement, the declaration of Sofia Minassian, and Plaintiff’s compendium of evidence with the Court.
