Having considered the petitioning papers, the Court rules as follows.
BACKGROUND
On July 27, 2022, Plaintiff Melanie Rong, by and through her guardian ad litem Lele Wang (“Plaintiff”), filed this action against Defendants Funbox LA (“Defendant”) and Does 1-100 for negligence and gross negligence.
On December 1, 2022, Defendant filed an answer.
On July 20, 2023, Petitioner Lele Wang submitted a petition for approval of minor’s compromise to be heard on August 24, 2023. The Court continued the hearing on the petition to September 15, 2023.
Trial is currently scheduled for January 24, 2024.
PARTY’S REQUEST
Petitioner Lele Wang asks the Court to approve the compromise of the pending action of Plaintiff Melanie Rong.
DISCUSSION
Petitioner has submitted a completed packet with all necessary attachments. However, the Court will not award attorney’s fees exceeding 30% of the gross balance. The Court reduces the attorney fees to $25,500.00. The new net balance is $49,239.24. The Court grants the motion with the reduced attorney’s fees and modified net balance.
Petitioner requests that the net balance be deposited in a single-premium deferred annuity as outlined in Attachment 18b(3). The Court orders the net balance so distributed.
CONCLUSION
The Court GRANTS the petition to approve the compromise of the pending action of minor Melanie Rong filed by Petitioner Lele Wang. The Court orders that the net balance of $49,239.24 be deposited in the single-premium deferred annuity outlined in Attachment 18b(3) of the petition.
