Having considered the documents submitted in support of a default judgment, the Court rules as follows. 

BACKGROUND 

On August 5, 2022, Plaintiff Interinsurance Exchange of the Automobile Club (“Plaintiff”) filed this action against Defendants Carlos Cruz Villegas, Carlos Cruz Pulido, and Does 1-10 titled “Complaint for Money (Automobile Subrogation – Includes Damages for Personal Injury).” 

On October 26, 2022, the clerk entered default against Defendants Carlos Cruz Villegas and Carlos Cruz Pulido.  On July 13, 2023, the Court dismissed Does 1-10 without prejudice at Plaintiff’s request. 

 On July 7, 2023, Plaintiff submitted a request for court judgment to be heard on September 5, 2023.  No opposition has been filed. 

Trial is currently scheduled for February 2, 2024. 

PARTY’S REQUEST 

Plaintiff Interinsurance Exchange of the Automobile Club requests that the Court enter default judgment against Defendants Carlos Cruz Villegas and Carlos Cruz Pulido and award Plaintiff $82,794.50, consisting of $77,242.68 as the demand of the complaint, $4,962.58 in prejudgment interest, $0.00 in attorney’s fees, and $589.24 in costs. 

DISCUSSION 

Plaintiff has submitted a completed default judgment packet, with all required attachments and sufficient proof of damages. The Court grants the request. 

CONCLUSION 

The Court GRANTS Plaintiff Interinsurance Exchange of the Automobile Club’s application for default judgment filed on July 7, 2023.  The Court enters judgment of $82,794.50 against Defendants Carlos Cruz Villegas and Carlos Cruz Pulido, jointly and severally. 

Plaintiff is ordered to give notice of this ruling.
