On February 16, 2023, Plaintiffs Phillip Armstrong (“Armstrong”) and Inger Burns (“Burns”) filed this action against Defendants Dennis H. Shiraga, Hideko H. Shiraga, and Does 1-25 for general negligence and premises liability.
On March 13, 2023, Defendants Dennis H. Shiraga and Hideko H. Shiraga filed an answer.
On January 28, 2025, Sharona Eslamboly Hakim filed a motion to be relieved as counsel for Armstrong and Burns. The motion was set for hearing on April 1, 2025.
On March 10, 2025, the parties filed a stipulation to continue the hearing on the motion to be relieved as counsel to June 11, 2025. The Court denied the stipulation and informed the parties that counsel could reschedule the hearing using the Court’s online reservation system. Counsel has not rescheduled the hearing.
Based on the parties’ expressed intention to continue the hearing because Burns has passed away and counsel needs time to search for Burns’ heirs, the Court continues the hearing to June 11, 2025 or the next available date. The Court will provide the date and time of the continued hearing at the April 1, 2025 hearing. The Court orders Plaintiffs' counsel to submit a declaration at least five days before the continued hearing describing efforts to locate Burns' heirs and to determine if one or more of Burns' heirs have agreed to serve as Burns' successors-in-interest in this case. Defendants may file a responsive declaration no more than two days before the continued hearing.
