Having considered the petitioning papers, the Court rules as follows.
BACKGROUND
On August 29, 2023, Plaintiff Mason Szuch (“Plaintiff”), a minor, by and through his guardian ad litem Alexander Szuch, filed this action against Defendants Todd Felderstein (“Defendant”) and Does 1-50 for motor vehicle tort and general negligence.
On September 14, 2023, the Court appointed Alexander Szuch to serve as Plaintiff’s guardian ad litem.
On October 24, 2024, Petitioner Alexander Szuch (“Petitioner”) filed a petition for expedited approval of the compromise of Plaintiff’s claims.
PETITIONER’S REQUEST
Petitioner
asks the Court to grant the petition for expedited approval of the compromise
of minor Plaintiff's claims.
Section 14b of the petition lists $3,125.00 in costs for “Med Pay.” Medical expenses should not be listed in Section 14b. Petitioner should explain the basis for this cost item.
Section 11a of the petition states that the gross settlement amount is $43,125.00. Section 17a states that the gross settlement amount is $40,000.00. The figures should be consistent.
The Court denies the petition.
CONCLUSION
The Court DENIES without prejudice the petition to approve the compromise of minor Plaintiff Mason Szuch’s claims filed by Petitioner Alexander Szuch on October 24, 2024.
Petitioner is ordered to give notice of this ruling.
Petitioner is ordered to file the proof of service of this ruling with the Court within five days.
