Final Accounting

 

The Final Accounting was set for September 1, 2023. The Court ordered Plaintiff to file a final report at least nine court days prior to the hearing.

On August 15, 2023, the Settlement Administrator filed her declaration. (ROA 135). The Administrator attests that all settlement checks were mailed on March 10,

2023. [Admin. Decl., ¶ 8.] On July 10, 2023, a reminder postcard was mailed to 17 Class Members whose checks remained uncashed. [Ibid.] The Administrator further attests that the check cashing period will expire on September 6, 2023. [Ibid.] As of August 2, 2023, there are 13 uncashed checks totaling $24,503.77. [Id., ¶ 9.]

The Administrator attests that after the expiration of the check cashing period, all uncashed funds will escheat to the State Controller’s Office. The Administrator will send the requisite unclaimed property report to the State Controller in October 2023. Following the reporting, the State Controller will attempt to locate updated addresses for Class Members who did not cash their settlement checks, and notify them of the settlement checks being held for them by the Administrator. Once the Class Member contacts the Administrator, their check will be reissued and mailed to them. If any settlement checks remain uncashed by June 2024, the Administrator will remit all remaining unclaimed funds to the State Controller’s Office. Accordingly, the Administrator attests that the entire settlement process will be completed in or around June 2024. [Admin. Decl., ¶ 9.]

RULING:

The Final Accounting hearing is CONTINUED to July 12, 2024, at 1:30 p.m. in Department CX103 so that the settlement administrator can complete administration of the settlement.

Counsel is ORDERED to file a supplemental administrator’s declaration no later than ten (10) calendar days prior to the continued hearing date. Plaintiff to give notice of the Court’s ruling, including to the LWDA.

The Court does not require any physical or remote appearance at the hearing.
