Motion to Dismiss

Ruling: The Court denies the motion without prejudice. First, the Court has no jurisdiction to hear this Motion, as the Court of Appeal has not yet issued a remittitur in Court of Appeal Case No. G058765. Second, even if the Court had jurisdiction, the moving parties did not properly serve the Motion on all the parties in the consolidated action. Finally, should the moving parties bring this motion again, the Court reminds all parties that a Notice of Appeal divests this Court of jurisdiction per CCP § 583.340(a).
