Final Accounting

The administrator reports that all settlement checks were issued and mailed on July 22, 2022, to each Class Member, Class counsel, Plaintiff, Phoenix Settlement Administrators for administration fees, and the LWDA. The check-cashing period expires on January 18, 2023. As of November 20, 2022, 303 checks in the amount of $148,976.93 remain uncashed. Per stipulation, the remaining uncashed amount will be sent to the California State Controller’s Office – Unclaimed Property Fund.

RULING:

The distribution efforts are in progress and approximately six weeks remain before the check-cashing period expires. Therefore, the hearing is continued to March 3, 2023, so the administrator can confirm the number of checks that remain uncashed. Plaintiff must provide proof of service no later than 5 court days prior to the continued hearing.

No appearance is required on December 2, 2022.
