Final Accounting:
The administrator reports that all settlement checks were issued and mailed on August 1, 2022, to each Aggrieved Employee, Plaintiff’s Counsel, Guadalupe Vargas as the PAGA Representative, Simpluris, and the LWDA. The check-cashing period expires on January 28, 2023. As of November 8, 2022, 106 checks in the amount of $19,571.54 remain uncashed. Per stipulation, the remaining uncashed amount will be sent to the California State Controller’s Office – Unclaimed Property Fund.
RULING:
The Order of the Court required Plaintiff to submit a copy of the Order to the LWDA within ten calendar days of entry and provide proof at the final accounting hearing. (ROA 132, ¶6.) Further, the distribution efforts are in progress and more than two months remain before the check-cashing period expires.
Therefore, the hearing is continued to February 24, 2023, so the administrator can confirm the number of checks that remain uncashed and so Plaintiff can provide proof of submission of the Order to the LWDA. Plaintiff must provide proof of service no later than 5 court days prior to the continued hearing. The status conference is also continued to February 24, 2023.
No appearance is required on November 18, 2022.
