RULING:

On December 21, 2021, Plaintiff filed its initial Motion for Approval of PAGA Settlement (ROA 91). On September 9, 2022, the Court issued a ruling notifying Plaintiff of several concerns to be addressed (ROA 120) and continuing the hearing to December 9, 2022. The Court ordered Plaintiff to file supplemental declarations, materials, and redlines addressing the Court’s concerns no later than 14 calendar days prior to the continued hearing date.

A new declaration, proof of service, and supplement were not served until four days before the hearing on December 5, 2022. There were a number of issues to be addressed in the Court’s Order on September 9, 2022. The Court needs more than four days to compare the new submissions to the prior Order and the prior submissions. Therefore, the Court continues the hearing to April 7, 2023, at 1:30 p.m. in Dept. CX 103. This is the first available hearing date on the Court’s calendar.

No appearance is necessary at the December 9, 2022 hearing.
