TENTATIVE RULING The motion to be relieved as counsel filed by Attorney Timothy Galvin is OFF CALENDAR.
'The notice of motion and motion, the declaration, and the proposed order must be served on the client.' (Cal. Rules of Court, rule 3.1362(d).) 'The notice may be by personal service, electronic service, or mail.' (Ibid.) The papers may be served by mail to the clients last known address, provided the attorney 'has been unable to locate a more current address after making reasonable efforts to do so within 30 days before the filing of the motion to be relieved.' (Id. at rule 3.1362(d)(1)(B).) As set forth in rule 3.1362, Attorney Galvin needed to serve this motion on his client, Plaintiff Fred Inscore. However, there is no proof of service on file.
Attorney Galvin declares that he has been unable to confirm Plaintiff Fred Inscore's current address despite calling Inscore's last known telephone numbers and conducting an unspecified 'search.' To the extent Attorney Galvin is unable to confirm Inscore's current address despite reasonable efforts, he must still serve the papers by mail to Inscore's last known address. (Cal. Rules of Court, rule 3.1362(d)(1)(B).) As Attorney Galvin has yet to satisfy the service requirements, the motion is off calendar.
