TENTATIVE RULING Plaintiff Daniel Lupercio's unopposed motion for preliminary approval of class action and PAGA settlement is GRANTED as set forth below.

Plaintiff shall modify section 4.b. of the class notice to clarify that Individual PAGA Payments will be calculated by dividing only $12,500 (rather than the full $50,000 allocated to the claim) among the Aggrieved Employees.

Plaintiff shall attach a copy of the modified class notice to a new proposed order. Plaintiff shall also modify the first sentence of Paragraph 12 of the proposed order accordingly.

The motion is otherwise approved. The Court sets a final approval hearing for January 26, 2024 at 10:30 a.m.

The motion for final approval shall include sufficient information about the time spent/tasks performed by Lupercio's attorneys to enable the court to conduct a lodestar cross-check. (See Laffitte v. Robert Half Int'l Inc. (2016) 1 Cal.5th 480, 504–505.) Calendar No.: Event ID:  TENTATIVE RULINGS
