TENTATIVE RULING
The Court GRANTS Defendant Pacific Plumbing Company of Southern California’s application for Ashley Jew Markham to be admitted pro hac vice. The Court will sign the proposed order.
Defendant Pacific Plumbing Company of Southern California is ordered to give notice.
BACKGROUND
This is a personal injury action. On January 8, 2025, plaintiff Krishna Alturi (Plaintiff) filed this action against defendants Ricky Madrigal, Pacific Plumbing Company of Santa Ana dba Pacific Plumbing of Southern California (Pacific Plumbing Company) and Does 1 to 50, alleging causes of action for negligence, negligence per se, negligent entrustment, and negligent hiring, supervision & retention.
On May 1, 2025, Pacific Plumbing Company applied for Ashley Jew Markham to be admitted pro hac vice. The application is unopposed.
LEGAL STANDARD
Any attorney licensed to practice before the bar of any United States court or the highest court in any state, and who has been retained to appear in a particular cause pending a court of this State, but who is not a licensee of the California State Bar may apply to appear pro hac vice in this State by submitting his written application and mailing notice to all interested parties, as well as notice and a $50.00 application fee to the State Bar Association in San Francisco.¿ (Cal. Rules of Court, rule 9.40, subds. (a), (c), (e).)¿ An applicant may not reside or work in California, and may not perform regular or substantial business, professional, or other activities here. (Id., rule 9.40, subd. (a).)
DISCUSSION
Pacific Plumbing Company submitted the verified application of attorney Ashley Jew Markham (Markham) to be admitted pro hac vice as counsel. Markham is admitted to practice in the state of Tennessee and in three federal district courts in Tennessee. (Markham Decl., ¶¶ 3-4.) Markham is in good standing with the state bar of Tennessee and the three federal district courts in Tennessee. (Markham Decl., ¶¶ 3-5.) Markham is not currently suspended or disbarred in any court and is not regularly engaged in the practice of law or other business in California. (Markham Decl., ¶¶ 5-6.) Markham resides in Tennessee and has an office is in Nashville, Tennessee. (Markham Decl., ¶¶ 2-3.) Markham has not applied to appear pro hac vice in any other action in California over the past two years. (Markham Decl., ¶ 7.) The California attorney of record is Matthew P. Smith, and Markham provided Mr. Smith’s contact information. (Markham Decl., ¶ 8.) Mr. Smith’s declaration indicates payment of the filing fee. (Smith Decl., ¶ 7.) The proof of service also indicates mail service of the application on all counsel and the State Bar of California. (Proof of Service, pp. 10-12 of pdf.)
The Court finds this application sufficient. Accordingly, the Court GRANTS the application.
CONCLUSION
The Court GRANTS Defendant Pacific Plumbing Company of Southern California’s application for Ashley Jew Markham to be admitted pro hac vice. The Court will sign the proposed order.
