JERRY DORFMAN vs BLOOM ENERGY CORPORATION

Motion to Continue Trial

TENTATIVE

Moving party requested a trial date of May 18, 2024, or the nearest date thereafter. The motion to continue trial and all related trial dates is GRANTED.  Moving party to give notice.

DISCUSSION

Taylor moves for a continuance of trial and related dates to May 18, 2024, or the nearest date thereafter, on the grounds that it is in the interest of justice and there are no alternative means.

Taylor testifies that BLOOM and TAYLOR are both actively working with Plaintiff’s counsel to set a mediation date and move this action towards alternate dispute resolution. (Shepherd Decl., ¶ 7.) Additionally, assuming mediation is not successful, TAYLOR will need additional time to receive and complete discovery (Id., ¶ 6.)

Good cause exists to continue trial because Taylor and other parties are attempting to move this action towards alternate dispute resolution and need time to schedule and attend mediation. Additionally, if mediation is not successful, additional time for discovery will be needed. This is the fifth continuance in this matter. No opposition was filed against this regularly noticed motion.
