TENTATIVE
This ruling in no way provides independent justification or an automatic granting of a continuance of the trial. Defendant's Motion to Compel Responses to Request for Production of Documents is granted. Plaintiff is to provide verified responses and produce documents within 20 days. The Request for Sanctions is denied.
DISCUSSION
Defendant styled this motion as a Motion to Compel Further Responses. However, this is a motion to compel initial responses. Under California law, unsworn responses are tantamount to no responses at all. (See Appleton v. Superior Court (1988) 206 Cal.App.3d 632, 636 [holding that unverified responses are tantamount to no responses.]) Discovery was propounded on December 22, 20222. Plaintiff served unverified responses on March 6, 2023. As of the filing of the motion, no verifications were served. As such, the instant motion is granted. The Court declines to award sanctions as this motion is unopposed.
