Ruling: Counsel's Motion to be Relieved is granted. Entry of the Court's order granting the motion to be relieved is delayed pursuant to CRC Rule 3.1362(e). Moving party to give notice.
Discussion:
Counsel has filed the requisite forms pursuant to CRC Rule 3.1362.
Counsel declares that there has been no communication with the client and that the client has failed to respond to phone calls and communications. Thus, Counsel seeks to be relieved. The Court is satisfied that there is a compelling reason to withdraw.
The Final Status Conference is set for January 10, 2024, and the Non-Jury Trial is set for January 24, 2024. As such, the Court determines that Plaintiff will not suffer prejudice if Counsel is permitted to withdraw.
Counsel has served the forms on Defendant and Plaintiff’s last known address, and states that counsel has been unable to confirm that the address is current after making the following efforts: mailing the motion papers to client’s last known address, return receipt requested; calling the client’s last known telephone numbers; and conducting a skip trace search using client’s last known address, driver’s license, and date of birth. This is sufficient.
