Motions to Compel Responses are GRANTED. Plaintiff is ORDERED to serve responses, without objection, to Defendant’s Form Interrogatories (Set One), Special Interrogatories (Set One) and Request for Production of Documents (Set One), within 20 days of the issuance of this order. Moving party is ordered to give notice.¿¿
Defendant moves to compel Plaintiff to provide responses to the discovery requests. On June 16, 2023, Defendant propounded the requests on Plaintiff. (Motion 3: 3-6; Dec. Tishkoff, ¶ 2.) Plaintiff had until July 19, 2023, to provide responses. However, Plaintiff has failed to provide any responses. Defendant attempted to meet and confer with Plaintiff, which is not a requirement, but Plaintiff did not response. (Motion 3: 11-20; Dec. Tishkoff ¶ 3.) Defendant is entitled to responses. Under CCP § 2030.290(b), when a party fails to provide responses to interrogatories, the propounding party may move to compel responses. Further, failure to respond timely waives all objections, including privilege and work product.¿ (Code Civ. Proc., § 2030.290, subd. (a).)¿
