Motion to Be Relieved as Counsel for Plaintiff

Tentative Order:  The Court GRANTS the motion to be relieved as counsel on the condition that Counsel files the updated MC-053 form. Counsel should also note that after the orders are signed, the orders will only become effective upon the filing of a proof of service of a signed copy of each order on Client. Counsel will remain the attorney of record until Counsel files with the Court proof of service of the signed orders. Counsel will be ordered to serve a copy of the signed orders (MC-053) on all parties, including Client, within three days.  The Court sets a Status on Representation of Plaintiff for September 19, 2023, at 8:30 am.  Moving party to give notice.


Rationale:  

The Court is satisfied that compelling reasons exist to grant the motion and that Plaintiff will not be unduly prejudiced by the withdrawal.  The one problem the Court notes is that the MC-053 form Counsel submitted has outdated future hearing date information, as many of the hearings and dates identified therein changed following Counsel’s filing of the instant motion. This can easily be remedied by Counsel submitting an updated MC-053 form containing the current future hearing dates. Accordingly, the Court GRANTS the motion to be relieved as counsel on the condition that Counsel files the updated MC-053 form.
