Ruling:  Motion to Dismiss is DENIED.  Moving party to give notice.

Discussion:  Dismissing for failure to serve defendants within two years is discretionary on the Court.  The Court declines to exercise its discretion in that manner.  Further, Defendants fail to show how the delay has impacted their ability to defend the suit. Only conclusory statements were made in that regard.
