Ruling: Denied.
Rationale:
In October 2022, Defendant was on notice that Plaintiff was seeking the court's permission to allow a jury trial and late posting of jury fees. On December 2, 2022, the Court ruled in Plaintiff's favor. Defendant had all the facts necessary to determine whether it would file a motion for summary judgment. Afterwards, on December 7, 2022, the parties stipulated to the current trial date. The Court made it clear that it would consider it a firm date.
Thus, the Court does not find good cause to continue the trial date. Defendant has not complied with its obligations of filing and serving its motion for summary judgment by April 14, 2023, which is 105 (30 + 75) days from the trial date. Reserving a motion without more does not amount to good cause, since the reservation system is not a tool for subverting the Code of Civil Procedure nor the California Rules of Court.
