Defendant’s Motion for Order Allowing Late Filing of Defendant’s Motions in Limine and Oppositions to Plaintiff’s Motions in Limine is DENIED without prejudice. Moving party to give notice.

Legal Standard

“The court may, upon any terms as may be just, relieve a party or his or her legal representative from a judgment, dismissal, order, or other proceeding taken against him through his or her mistake, inadvertence, surprise, or excusable neglect.” CCP §473(b).

Discussion

Given that in the Personal Injury Court system this case will be tried by a different court than the court ruling on Motions in Limine, the Court finds it appropriate for the trial judge to determine any issues regarding the timeliness of such motions, or the oppositions thereto.
