Discussion
Defendants/Cross-Defendants/Cross-Complainants Jeremy Maltz and Teresa Maltz (“Maltz”) move for a continuance of trial and related dates to at least December 16, 2024. This date is requested as it is seventy-five (75) days past the hearing date on Maltz’s Motion for Summary Judgment on June 6, 2024.
Maltz’s counsel testifies that Maltz filed their Motion for Summary Judgment on October 20, 2023, and the earliest available date on the Court’s reservation system was October 1, 2024. (Kraft Decl., ¶ 3.) Additionally, Counsel testifies that the earliest date the Motion for Summary Judgment could be heard, based on the trial date, is January 17, 2024, and that date is unavailable. (Id., ¶ 4.)teGood cause exists for a continuance of trial. Maltz’s motion for summary judgment was timely filed. Since the hearing for Maltz’s motion was set for a date after trial due to unavailability in the Court’s calendar, Maltz’s motion is granted. No other parties have opposed this motion.
