Plaintiff’s Motion to Set Aside the Dismissal is GRANTED. The Court sets an OSC re dismissal for failure to enter default pursuant to CRC rule 3.110(g), CRC rule 3.740, CCP 581(b)(4), CCP 583.410, and 583.420(a)(2)(B), and calendars it in 35 days. Plaintiff is ordered to file any responsive paperwork no later than five days prior to the hearing pursuant to CRC Rule 3.110(i). Clerk to give notice.

Discussion

Through Court inadvertence, the case was dismissed at the non-appearance case review without the presence of counsel, instead of at the OSC dated November 27, 2023. As such,  Plaintiff’s Motion to Set Aside the Dismissal is GRANTED.
