TENTATIVE

Defendants Ryder Truck Rental Inc., Vitco Distributors Inc., and Vladimir Gonzalez’s motions to compel Plaintiff Inger Lorre-Wening to provide responses to provide responses to special interrogatories and request for production of documents, are DENIED without prejudice.

Defendant’s request for sanctions is DENIED.

Moving party is ordered to give notice.

Discussion

The motion is denied on procedural grounds. On July 28, 2023, Defendant served Special Interrogatories, Set Two, and Request for Production of Documents, Set Two, on Plaintiff. (Thacker Decl., ¶ 2; Exh. A.) Responses were due on or before August 29, 2023. To date, responses have not been provided. (Id., ¶ 4.)

The discovery at issue is not attached to the motion, and there is no proof of service indicating the discovery was served on Plaintiff. Thus, the Court cannot grant this motion without determining whether the discovery was properly served on Plaintiff. As a result, the motion is denied.

As the motion is denied, the request for sanctions is also denied.
