Ruling: Counsel's Motion to Be Relieved as Counsel is granted. Entry of the Order granting the Motion to Be Relieved as counsel is delayed pursuant to CRC Rule 3.1362(e). Moving party to give notice.
Discussion:
Counsel has filed the requisite forms pursuant to CRC Rule 3.1362. The Court finds that a compelling reason to seek withdrawal exists. The next hearing dates are the Final Status Conference set on February 1, 2024 and the Trial set on February 15, 2024. As such, the Court determines that Plaintiff will not suffer undue prejudice if Counsel is permitted to withdraw.
Counsel has served the forms on Defendant and Plaintiff’s last known address, and states that counsel has been unable to confirm that the address is current after making the following efforts: mailing the motion papers to client’s last known address, return receipt requested; calling the client’s last known telephone numbers; emailing the client, and conducting a comprehensive search using a professional agency. This is sufficient.
