TENTATIVE

The motion to continue trial is GRANTED. The current trial and final status conference dates are advanced and vacated. The trial is continued to December 5, 2024, at 8:30 am, in Dept. 30.  The Final Status Conference is continued to November 21, 2024, at 10:00 am, in Dept. 30.  All trial-related deadlines are continued in accordance with the new trial date.  Moving party to give notice.

The Defendant moves for a continuance of trial and related dates to December 5, 2024, to allow a Motion for Summary Judgment to the Complaint to be heard.

Defense counsel testifies that the earliest date Department “30” can hear a motion for summary judgment with the notice requirement of Section 437c is in September 2024. (Rai Decl., ¶4.) Additionally, Defendant will need time to conduct expert discovery in the event its motion for summary judgment is denied. (Id., ¶ 5.)

Good cause exists to continue trial because Defendant is within the time frame of section 437c to file its summary judgment motion. The motion to continue trial is granted.
