TENTATIVE

Defendant Activ Enterprises, LLC’s motion to compel responses is GRANTED. Plaintiff Darren Patrick Rodgers is ORDERED to serve verified responses, without objection, to Defendant Activ Enterprises, LLC’s Special Interrogatories, Set Two, within 20 days of the issuance of this order. Moving party to give notice.

DISCUSSION

Defendants are entitled to an order compelling Plaintiff’s responses to Defendant Activ’s Special Interrogatories, Set Two. The set of interrogatories were properly served on Plaintiff on February 7, 2023. (Declaration of Christopher A. Dixon, ¶ 3; Exh. A.) The responses were due by March 9, 2023. (Ibid.) Plaintiff has not served responses as of the date of drafting the instant motion. (Dixon Decl., ¶ 5.) Failure to timely respond waives all objections, including privilege and work product.¿ (Code Civ. Proc., § 2030.290, subd. (a).)¿ Plaintiff does not oppose this motion.
