The Court exercises its discretion in staying the civil proceedings.  This involves a collision which is the subject of both the civil and criminal matter. Due to defendant's 5th Amendment rights, discovery will be impacted to the extent that Court intervention would likely be required.  In weighing the Avant! factors, Court resolves them in favor of the stay.  Avant! Corp v. Superior Court (2000) 79 Cal.App.4th 876, 885.
