Amended Pleading – The instant motion was filed on November 3, 2023, prior to the now-operative First Amended Complaint, filed on November 27, 2023. The substance of the instant motion includes arguments based on lack of personal jurisdiction. It appears the FAC has been substantively amended. Moreover, Defendant Sakuo Kikuchi, who is deceased, and whose service is being challenged, has been removed from the FAC. As such, the Court takes the instant motion off-calendar as moot.
