Re:  Motion to Be Relieved as Counsel for Plaintiff

Tentative Ruling:  Counsel’s Motion to be Relieved as Counsel for Plaintiff Maria Luisa Gonzalez is GRANTED.  Pursuant to CRC Rule 3.1362(e), a copy of the signed order must be served on the client and on all  parties that have appeared in the case.  The effective date of the order relieving counsel is delayed until proof o
f service of a copy of the signed order on the client has been filed with the Court.  Moving party to give notice.

Discussion:  

Counsel filed a Notice of Motion and Motion to be Relieved as Counsel (MC-051), an Order Granting Attorney’s Motion to Be Relieved as Counsel (MC-053), and a Declaration in Support of Attorney’s Motion to Be Relieved as Counsel (MC-052) on the appropriate forms, as outlined within California Rules of Court, rule 3.1362, subdivisions (c), and (e). (Cal. Rules of Court, rule 3.1362, subd. (c), (e).)

Counsel indicates that he served Plaintiff and Defendant’s counsel with copies of forms MC-051, MC-052 and MC-053 via mail and electronic service, respectively. (MC-052, Item #3.; MC-051, p. 3; MC-052, p.3; MC-053, p. 3.)

Plaintiff will not be prejudiced if Counsel’s motion is granted, as trial is scheduled for May 15, 2024, giving Plaintiff adequate time to secure new counsel before trial. The Court is satisfied that Counsel has a compelling reason to withdraw. (MC-052, Item #2.)
