Re: Motions to Be Relieved as Counsel filed by Gerald R. Marcus, Counsel for Plaintiffs Daymonne Sampay and Angel Torres

Ruling: Counsel’s Motions to be Relieved as Counsel for Plaintiffs Daymonne Sampay and Angel Torres are GRANTED. Pursuant to CRC Rule 3.1362(e), a copy of the signed order must be served on the client and on all parties that have appeared in the case.  The effective date of the order relieving counsel is delayed until proof of service of a copy of the signed order on the client has been filed with the Court.

Rationale: The Court finds that Plaintiffs will not be prejudiced if Counsel’s motion is granted. The next hearing in this matter after Counsel’s motions to be relieved as counsel are heard is a final status conference scheduled for August 13, 2024. Trial is set for August 27, 2024. There is sufficient time for Plaintiffs to engage new counsel before trial. Further, the Court is satisfied that Counsel has a compelling reason to withdraw.
