TENTATIVE
The present motion pertains to Maureen Duffy and Christopher Nepacena of the firm Donahue Fitzgerald, LLP, who move to be relieved as counsel for Defendant Souley Vegan, LLC and Western Vegan, Inc. Nepacena presents a declaration stating that termination of the relationship is permissible under Rules of Professional Conduct, Rule 1.16, subd. (b)(1), (5), (7), and (10), which apply when a client persists in claims not warranted by existing law, the client breaches.a term of their agreement with the attorney, there is an inability to work with co-counsel, or there exists some other good faith basis for for withdrawal. (RPC Rule 1.16, subd. (b)(1), (5), (7), (10).) The motion complies with the above requirements. Trial in this matter is set to begin on October 21, 2025.
Maureen Duffy and Christopher Nepacena’s Motion to be Relieved as Counsel for Defendant Souley Vegan, LLC and Western Vegan, Inc. is GRANTED, , effective upon moving counsel filing with the court proof of service of a copy of the signed order on the client, as set forth in Cal. Rules of Court Rule 3.1362(e).
