TENTATIVE

Plaintiffs Oscar Quintero and Ivan Quintero (Plaintiffs) seek leave to add a fourth cause of action for fraudulent concealment and punitive damages to their lemon law claims, based on an alleged defect in the 10R80 defect in the subject vehicle. (Lopez Decl. Exh. A, ¶¶ 19–72.) Plaintiffs argue that the proposed amendment will cause no prejudice, as trial in this matter is not set until February 2026. (Motion at pp. 4–6.)

Plaintiffs have demonstrated good cause for the proposed amendment and an absence of prejudice resulting therefrom. Defendants have filed no opposition to this motion.

The motion is therefore GRANTED.

Plaintiffs Oscar Quintero and Ivan Quintero’s Motion for Leave to File First Amended Complaint is GRANTED. The proposed First Amended Complaint is ordered filed within 20 days of this Order.

Plaintiffs to give notice within five days.
