Ruling:  Granted. 

Counsel for Defendant is advised that the Court's Ruling and
Attorney's relief as Counsel of record for client is not effective until Proof
of Service of the Order signed by the Court upon the client is filed in this
action.  Until then, counsel continues to
be counsel of record.  Cal. Rules of
Court 3.1362(e). 

Moving party to give notice.

Rationale:  Defendant is in bankruptcy and a permanent injunction was issued prohibiting further actions against Defendant.  Plaintiff is enjoined from continuing this action under Kmart's bankruptcy plan.  A copy of the October 18, 2018 Notice of Bankruptcy was filed concurrently with Defense Counsel's declaration.  Counsel has shown a compelling reason to withdraw as the attorney of record and have submitted the appropriately filled out forms in support of their motion. CRC 3.1362.
